Here is my question : A Producer (composer of the song music etc ) created the music arrangements that existed (online Spotify iTunes / beatstars (for only leasing) - can a composer still own his masters of the sound and writing even if he/she released the instrumental album on all platforms and copyrighted years before ? I just wanted to know if they can still lease out song for a small fee from there copyrighted compositions And would they be able to send this same sound recording to other producers , would they now be a derivative work? (If not paid) they have the coproduction for it ?

Hey Stephanie I have a question 🙋🏻 So if in this instance if I were to sign a Producer’s Agreement.., it wouldn’t matter if I Copyrighted my instrumentals before signing the dreaded agreement?? I ask because I put my beats on Spotify, RUclips, & SoundExchange I also put it on BMI, Sony Music Publishing & HAAWK for Third party & even the MLC, but haven’t copyrighted just yet.. But If I were to copyright would it matter at all if I sign the producer agreement?

Technically you are right. Ethically, not so much. Yes, it does come down to publisher and owner of said copyright, as in the bittersweet symphony example where the Rolling Stones manager, not the Rolling Stones themselves, sued the writers of that song for breech. But there is something to be said for ethics, even in a business where people don’t pay and don’t acknowledge other people’s work. I am sure that something could have been worked out from a credit’s perspective, anything other than outright borrowing of the performance itself. What should happen and what people should stop doing is sampling altogether. Lifting other peoples riffs and ideas to capture the feel of something familiar rather than writing a completely new track and creating that feeling on your own is just a cheat. Sampling itself isn’t cheating, but obvious lifting of a track to create that sense of familiar only means that the person who created that vibe or feeling to begin with is reduced to a phrase. And in Kelis’ case, that never goes down well.

If an artist buys and exclusive beat which has been copyright already. After the artist add vocals to the beat can the artist (purchaser) still file a copyright of the master track?
